International Validity of Timestamps: eIDAS, Blockchain, and Global Legal Frameworks

What Does a Timestamp Legally Prove?

A cryptographic timestamp independently proves that specific digital data existed at an exact moment and that its cryptographic hash (SHA-256) has not been modified since.

Important Note: A timestamp does not validate the truthfulness of file contents or ownership itself. It proves beyond doubt that the exact digital data existed at that time and was not altered.

International Legal and Technical Frameworks

As a directly applicable EU regulation, eIDAS establishes clear legal status for trust services:

  • Article 3(33): Defines an electronic timestamp as data binding other electronic data to a specific time, proving it existed unchanged.
  • Article 41: Ensures an electronic timestamp cannot be denied legal effect or admissibility as evidence in court solely because it is electronic.
  • Article 42: Establishes a legal presumption of accuracy for Qualified Electronic Time Stamps (QTS) across all EU member states.

ETSI, RFC 3161, and ISO Standards

  • ETSI EN 319 421 & 422: Defines policy, security requirements, and protocol profiles for Time Stamping Authorities (TSA).
  • RFC 3161 (TSP): The internet standard protocol defining client-TSA communication and cryptographic response validation.
  • ISO/IEC Standards: ISO 18014 (Time-stamping), ISO 27001 (Information Security), and ISO 27037 (Digital Evidence Preservation).
